The present general conditions of sale concern the commercial relations between CONFISERIE CARLUCIENNE, Béquignolles, 24370 Carlux, registered in the commercial and companies register of SARLAT under number 647280171 and any natural or moral person wishing to buy in his shop through the website www.chocolats-confiseriecarlucienne.com
1. Purpose and scope:
These general conditions are intended to define the terms of sale between CONFISERIE CARLUCIENNE and its customers. They specify the conditions for the realization of the different steps of the sale, the order and the payment, until the delivery of the products and ensure the follow-up of this order between the parties.
CONFISERIE CARLUCIENNE will ensure its deliveries in France and European countries only. For the rest of the world, contact us.
2. The Order:

The customer agrees to provide the following informations:
• Surname, first name, full address, telephone, e-mail
• Description of Ordered products
• Quantities ordered
• Delivery address (if different from billing)
• Method of payment selected
The order is formalised and constitutes an irrevocable undertaking, (see statutory withdrawal period, paragraph 9):
• When validating the order on the site by the customer
• When the confirmation e-mail is sent by CONFISERIE CARLUCIENNE
The legal conditions for the exercise of the online purchase are provided for by articles 1124 and 488 of the Civil Code.

3. The Price:
Our prices are given french VAT included (in progress at the time of the order), in euros and without shipping costs.
Prices can change at any time: change in supplier prices, VAT, promotions. Any typographical error on the part of the CONFISERIE CARLUCIENNE will be corrected within 48 h and will not be attributable to it.
4. Shipping costs:
The shipping costs are fixed according to the prices in force at the time of the order applied by the french post for small and medium weight parcels (Colissimo if possible), or by special carrier for the objects of larger weight. 5. Payment of the Order:
The customer will have to pay by credit card on the Internet (CB, Visa, Mastercard). 6. Delivery:
CONFISERIE CARLUCIENNE undertakes to deal with the utmost care with orders and their shipments, the delivery times being given as an indication.
6.1 Preparation of order
The order preparation begins only when the order is definitively validated. Therefore, any delay in settlement will imply a delay in the preparation of the order

6.2 Delivery
Adverse weather conditions, such as too high heat, can lead CONFISERIE CARLUCIENNE to defer the dispatch of an order. In this case, the customer will be notified by e-mail and may decide to maintain or cancel his order.

The customer undertakes to check the condition of his parcel and to make possible remarks on the delivery bill in the presence of the carrier or the postman and, in case of damage, will exercise the remedy against the carrier (letter to the carrier with AR and Copy to CONFISERIE CARLUCIENNE). Any accepted package will not be reimbursed.
7. The case of force majeure:
Cases of force majeure may hinder the successful completion of an order and/or delivery and automatically suspend execution after a certain period of time:
• Strikes
• Natural disasters
These cases are in addition to those usually accepted by the French jurisprudence.
8. The claim for non-compliance:
Any claims concerning non-compliance or an error on the product sent must be made within 3 days after receiving the order

After this period, no claims will be accepted.
In the event of a non-compliant product or an error on the product sent, the product may be returned. However, any return of the product will have to be the subject of a formal agreement between CONFISERIE CARLUCIENNE and the customer, and be returned within 3 days following the agreement.
The CONFISERIE CARLUCIENNE preserves its right to take it back, exchange it or refund it provided that the error is at the initiative of CONFISERIE CARLUCIENNE. Any claim will be studied in good agreement and with common sense.

9. The right of withdrawal:
The 14-day withdrawal right (article L121-16 of the consumer code) does not apply to contracts for the supply of food perishable foodstuffs, such as chocolates. The customer will not be able to avail themselves of it. However, a cancellation on its part may be taken into account in so far as the parcel is not yet shipped, and the order will be reimbursed if the payment was finalized.
10. The Guarantee:
Article 1641 and following of the Civil Code: guarantee against hidden defects.
We guarantee the good quality of our products without the responsibility being sought beyond the pure and simple replacement of the defective goods at the start of the shop. Any claim for a case must be made to the carrier.
